1. Acceptance of Terms

By creating an account, logging in, or otherwise interacting with the Latin Melodies platform, you expressly accept and agree to abide by all provisions contained in these Terms. Your acceptance is effective upon your first use of the Service. These Terms apply to all visitors, users, members, and others who access the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective upon posting the updated Terms on the Platform. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Latin Melodies is an online social discovery and dating platform designed to facilitate connections between adults interested in Latin culture and relationships. Our Services include, but are not limited to:

3. User Responsibilities & Account

The Service and its original content, features, functionality, design, logos, trademarks, and compilation of member content are owned by Latin Melodies and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission.

By posting, displaying, or uploading any content ("User Content") on the Service, you grant Latin Melodies a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content in connection with the Service.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Latin Melodies, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service.
2. Any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users.
3. Any content obtained from the Service.
4. Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you have paid to Latin Melodies in the last twelve (12) months, or (b) one hundred U.S. Dollars (USD $100). This limitation applies regardless of the legal theory (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LATIN MELODIES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material obtained by you through the Service will meet your expectations.

We do not guarantee the accuracy, completeness, or usefulness of any information on the Service, including member profiles. We are not responsible for the conduct, whether online or offline, of any user of the Service. You are solely responsible for your interactions with other members.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us to deactivate your profile. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of a recognized arbitration body in the UK. The seat of arbitration shall be London. The language of the arbitration shall be English.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

11. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Latin Melodies regarding the Service and supersede any prior agreements.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
